Trucking Safety Rules


Commercial truck drivers and carriers must follow safety regulations designed to reduce roadway risks. Federal rules address driving hours, vehicle maintenance, inspections, driver qualifications, and other safety issues.


For example, the Federal Motor Carrier Safety Administration generally limits property-carrying drivers to 11 driving hours after 10 consecutive hours off duty. Drivers also generally cannot drive beyond the 14th consecutive hour after starting duty.


Nevada has additional requirements for certain commercial drivers. Under Nevada Revised Statutes Chapter 706, qualifying intrastate drivers generally face limits on driving and on-duty hours.


A violation does not automatically decide who caused an accident. However, safety records can become important evidence when investigators determine whether a driver or carrier acted reasonably.


Truck Accident Causes


Truck accidents can result from driver, vehicle, cargo, or roadway factors. Determining the cause requires evidence rather than assumptions.


Common issues may include speeding, distracted driving, fatigue, unsafe lane changes, poor vehicle maintenance, improper loading, or inadequate inspections. Weather and traffic conditions can also affect how safely a large truck can operate.


The scale of these crashes makes careful investigation especially important. FMCSA reported approximately 503,000 police-reported crashes involving large trucks in 2022. About 114,000 were injury crashes, while 5,279 were fatal crashes.


Those numbers do not show who was at fault in any individual collision. They do show why commercial truck safety remains an important issue for drivers and passengers.


Liability Responsibility


Liability in a semi-truck accident can extend beyond the person behind the wheel. The evidence determines which people or businesses may be legally responsible.


A driver may be responsible for unsafe driving. A trucking company may face questions about hiring, supervision, maintenance, scheduling, or other business practices.


Other parties may become relevant when defective equipment, poor repairs, or improperly secured cargo contributed to the crash. Identifying these parties can also reveal additional insurance coverage that may apply.


Nevada uses a comparative negligence system. Under NRS 41.141, an injured person can generally recover when their negligence is not greater than the negligence of the party or parties they pursue. Any assigned share of fault can affect the recovery.


Truck Accident Compensation


Compensation is intended to address losses caused by another party's negligence. The available damages depend on the facts and effects of each accident.


A claim may include medical expenses, lost income, reduced earning ability, property damage, and certain future losses. Compensation may also address pain, suffering, and other effects that cannot be measured through bills alone.


Medical records, wage information, expert analysis, and evidence from the crash can help document those losses. This process connects the accident to its financial and personal impact.


Deadlines also matter. Nevada law generally provides two years for actions seeking damages for personal injuries caused by another person's wrongful act or neglect, although exceptions can apply.
